   Trademarks. Among the trademarks and service marks owned by Symphony Technologies, are Dodge Data & Analytics Site and the respective logos of all the sites. All other trademarks and trade names are the property of their respective owners.

Responsibility.

(A)

Dodge Data & Analytics Site does not monitor this Site at all times, but reserves the right to do so. We take no responsibility for any material input by others and not posted by Dodge Data & Analytics Site. User acknowledges and agrees that user is solely responsible for the form, content and accuracy of any Proposal or Bid Notice or material contained therein placed by the user on Dodge Data & Analytics Site. Employers are solely responsible for their Proposal & Bid Notices. We are not responsible for the content of any other Web Sites linked to the Site; links are provided as Internet navigation tools only. Dodge Data & Analytics Site does not warrant or guarantee that any specific number of users shall view a Proposal or Bid Notice or that any specific user will view it.

(B)

Administrators of the Dodge Data & Analytics Site we will make every effort to provide a proof of the type-set print version of the Proposal or Bid Notice prior to publication, but if the print deadline passes, we hold the right to print the type-set version without your approval. Dodge Data & Analytics Site Administrators will, however, attempt to fulfill and execute the print version to the best of their ability given the time and resources allowed. However, Dodge Data & Analytics Site will not be held accountable for any changes to features, design or content other than those explicitly stated in the Project Details.

   Acceptable Site Use Rules
   
   (A)
   Specific Prohibited Uses. The Dodge Data & Analytics Site may be used only for lawful purposes by Construction Owners and Contractors to display announcements of construction project activity or other legal notices in the public and private sector. Dodge Data & Analytics Site specifically prohibits any use of this Site, and requires all users to agree not to use this Site, for any of the following:

   Do not post to Dodge Data & Analytics Site any incomplete, false or inaccurate Proposal & Bid Notice information. Do not post non-Proposal or non-Bid Notice information such as opinions or notices, commercial or otherwise. Third parties, including any third party charging a fee or restricting complete access to all Proposal & Bid Notice information, are prohibited.

   Do not respond to any Proposal or Bid Notice on Dodge Data & Analytics Site for any reason except to inquire about the project. Communications soliciting the Owner’s or Contractor's business by our competitors are prohibited.

   Do not post to Dodge Data & Analytics Site any franchise, pyramid scheme, "club membership", distributorship or sales representative agency arrangement or other business opportunity which requires an up-front or periodic payment, pays commissions only (no significant salary), requires recruitment of other members, sub-distributors or sub-agents.

   Do not delete or revise any material posted by any other person or entity.

   Do not print out or otherwise copy or use any personally identifiable information about Owner’s or Contractor’s business information about employers. Unsolicited email, telephone calls mailings or other contacts to posting individuals and companies are prohibited.
   
   (B)
   Web Site Security Rules. Users are prohibited from violating or attempting to violate the security of Dodge Data & Analytics Site, including, without limitation, (a) accessing data not intended for such user or logging into a server or account which such user is not authorized to access, (b)attempting to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures without proper authorization, (c) attempting to interfere with service to any user, host or network, including, without limitation, via means of overloading, "flooding," "mailbombing" or "crashing," or (d) sending unsolicited email, including promotions and/or advertising of products or services, or (e) attempting to secure confidential information purposely withheld from Owner’s or Contractor’s (f) forging any TCP/IP packet header or any part of the header information in any email or newsgroup posting. Violations of system or network security may result in civil or criminal liability. Dodge Data & Analytics Site will investigate occurrences that may involve such violations and may involve, and cooperate with, law enforcement authorities in prosecuting users who are involved in such violations.
   
   (C)
   General Rules. Users may not use this Site in order to transmit, distribute, store or destroy material (a) in violation of any applicable law or regulation, (b) in a manner that will infringe the copyright, trademark, trade secret or other intellectual property rights of others or violate the privacy or publicity or other personal rights of others, or (c) that is libelous obscene, threatening, abusive or hateful.

   Suspension. Any user which Dodge Data & Analytics Site determines to have violated any element of these Acceptable Site Use Rules may receive a written warning, and will be subject at our discretion to a temporary suspension of service pending such user's agreement in writing to refrain from any further violations; provided, however, that if we deem it necessary, we may immediately suspend or terminate such user's service without issuing such a warning. Users, which we determine to have committed a second violation of any element of these Acceptable Site Use Rules, shall be subject to immediate suspension or termination of services without further notice.

   Privacy. We will attempt to keep all personally identifiable information posted to Dodge Data & Analytics Site confidential. You must view your completed Proposal &Bid Notice template to insure that you have not included any confidential or identifying information in any areas viewable by others. All personally identifiable information posted to Dodge Data & Analytics Site is not guaranteed to be confidential and will be viewed by Dodge Data & Analytics Site employees, and any other sources the user authorizes. We reserve the right to use your information for advertising purposes (unless you've deselected the pre-checked box during user registration regarding your acceptance of the terms and conditions of the site privacy statement as it applies to third party users, or if we have received and confirmed an email request by you not to do so). We also reserve the right to contact you about our Proposal & Bid Notice services, and/or to share with you other notice posting opportunities. Dodge Data & Analytics Site cannot police or enforce its rules against all third party users; you should communicate with the user if you object to being contacted and want to restrict or stop their use. You may send your request by email to official.bids@construction.combut due to the volume of email we receive, it may not secure prompt attention.

   Use by Minors. The vast majority of Proposal & Bid notices on Dodge Data & Analytics Site are intended for adults. Users under the age of 16 should not use Dodge Data & Analytics Site. Users between the ages of 16 and 18 should be certain they ask their parent's consent before using Dodge Data & Analytics Site or otherwise providing any personally identifiable information.
